RCMP NL say refusing to provide a breath sample is a criminal offense

    If convicted, a charge of refusing to comply with a demand carries the same penalty as a conviction for a charge of impaired operation.

    A 29-year-old man was arrested in Stephenville Tuesday night and charged with drug impaired operation. Bay St. George RCMP stopped a vehicle on Main Street shortly before midnight. A quantity of cannabis was inside the vehicle, near the driver.  Cpl Jolene Garland says the man initially refused to exit the vehicle but completed roadside sobriety testing. He performed poorly and was taken to the Sir Thomas Roddick Hospital, where he refused to provide a blood sample. Garland says refusing to comply with a demand issued as part of an impaired driving investigation is a criminal offence. If convicted, a charge of refusing to comply with a demand carries the same penalty as a conviction for a charge of impaired operation. The man is set to appear in court on April 7th, 2025.  His licence was suspended and the vehicle was seized and impounded.
