St. George's council ordered to release information after an ATIPPA request

    A complainant made an access request to the Town of St. George’s requesting a letter referenced in the minutes of a council meeting.

    The town of St. George’s has been ordered to make some information available after a complainant filed under the  Access to Information and Protection of Privacy Act. A complainant made an access request to the Town of St. George’s requesting a letter referenced in the minutes of a council meeting. The Town refused access on the grounds the contents of the letter were confidential and that it was withholding the letter under section 39 (disclosure harmful to business interests of a third party). The Information and Privacy Commissioner found the Town had not met the three-part test to withhold the information under section 39 and recommended the letter be disclosed to the Complainant.
